Part A: Common Provisions
§1 Scope and Definitions
(1) These General Terms and Conditions (GTC) apply to all contracts between Click A Tree GmbH (hereinafter “we” or “Click A Tree”) and its customers—both for individual orders and subscriptions placed through our online store (Part B) as well as for collaborations with business partners who integrate tree plantings or other impact projects into their business model (Part C).
(2) For the purposes of these Terms and Conditions, “customers” include both consumers (§ 13 BGB) and business entities (§ 14 BGB), unless otherwise expressly provided.
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to the person’s independent professional activity.
(4) A business operator is a natural person, a legal entity, or a partnership with legal capacity that, at the time of entering into the legal transaction, is acting in the course of its commercial or self-employed professional activities.
(5) Part B applies to orders placed through our online store at https://clickatree.com. Part C applies additionally and takes precedence for collaborations with business partners, regardless of whether the order is placed through the online store, via a quote, or as part of an onboarding meeting. In case of any conflict, individual written agreements between Click A Tree and a partner shall take precedence over these Terms and Conditions.
Part B: Online Store (Individual Orders & Subscriptions)
§2 Formation of a Contract, Storage of the Contract Text
(1) The following provisions regarding the conclusion of contracts apply to orders placed through our online store at https://clickatree.com.
(2) If a contract is concluded, the contract takes effect upon

(3) The presentation of goods and services in our online store does not constitute a legally binding offer to enter into a contract on our part, but is merely a non-binding invitation to the customer to place an order. By placing an order, the customer submits a binding offer to enter into a contract.
(4) Upon receipt of an order in our online store, the following provisions apply: The customer submits a binding offer to enter into a contract by successfully completing the ordering process provided in our online store.
The ordering process consists of the following steps:
- Selecting the Desired Service
- Confirm by clicking the “Order” button
- Binding submission of the order by clicking the “Place Order” or “Buy” button
Before submitting a binding order, the customer may, after reviewing their information, return to the web page where the customer’s information is entered by clicking the “Back” button in the web browser they are using, and correct any input errors or cancel the order process by closing the web browser. We will immediately confirm receipt of the order via an automatically generated email (“Order Confirmation”). With this, we accept your offer.
(5) Storage of the Contract Text: We store the contract text and send you the order details via email. You can view the Terms and Conditions at any time at https://clickatree.com/agb. You can view your past orders in our customer area under “My Account” > “My Orders.”
§3 Prices, Payment, Due Date
(1) The prices listed in our online store are exclusive of the applicable statutory sales tax, unless otherwise expressly stated. The prices are generally net prices and are primarily intended for business customers. For orders placed by consumers, the price displayed during the ordering process includes the applicable sales tax.
(2) In the online store, customers can pay by credit card (Visa, Mastercard, American Express), invoice, PayPal, SEPA direct debit, Apple Pay, and Google Pay. The payment methods available in each individual case depend, among other things, on the customer’s billing and shipping countries and are displayed during the ordering process.
(3) If the “Invoice” payment method is selected, the invoice amount is due for payment within 14 days of the invoice date, without any deductions, unless otherwise agreed.
§4 Subscriptions
(1) Certain services can be subscribed to with monthly recurring payments.
(2) Unless otherwise specified for a particular product, subscriptions are monthly and have no minimum term. The subscription automatically renews for another month unless it is canceled before the end of the current billing period.
(3) The customer may cancel their subscription at any time, effective at the end of the current billing period. Cancellation can be done in the customer account under “My Account” using the cancellation feature provided there—it only takes a few clicks. Cancellation via email to info@clickatree.com is also possible at any time.
(4) At the start of a new billing period, the amount due will be automatically charged using the payment method provided when the contract was signed.
(5) We will notify you in writing (e.g., by email) of price adjustments for current subscriptions at least 30 days before they take effect. If the customer does not object by the effective date, the price adjustment shall be deemed accepted; we will specifically point out this right to object and the legal consequences of remaining silent in the notification. In the event of an objection, the customer has a special right to terminate the subscription effective as of the date the price adjustment takes effect.
§5 Provision of Services
(1) We plant the selected trees or provide the booked service at the next possible, appropriate time (depending on the season) in the respective project region. Planting is carried out in batches: We collect orders until we have reached an economically and practically feasible number of trees for the respective project region, and then carry out the planting all at once. Therefore, several weeks or months may elapse between the order and the actual planting on site. There is no physical delivery of goods to the customer.
§6 No Transfer of Ownership
By placing an order, the customer does not acquire any ownership rights to the planted tree, the planted area, or the underlying property. Payment is made exclusively for the tree-planting service or the respective Impact project. Ownership of the land and the tree remains with the local project partners or the local people in the respective project country.
§7 Right of Withdrawal for Consumers
This right of withdrawal applies exclusively to consumers.

You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the date the contract is concluded.
To exercise your right of withdrawal, you must notify us

by providing a clear statement (e.g., a letter sent by mail or an email) regarding your decision to withdraw from this contract. You may use the attached sample withdrawal form (see attachment), but this is not required. A short, informal message is sufficient.
To comply with the cancellation period, it is sufficient for you to send notification of your intention to exercise your right of cancellation before the cancellation period expires.
Consequences of Cancellation
If you cancel this contract, we must refund all payments we have received from you without delay and no later than fourteen days from the date on which we received notice of your cancellation of this contract. We will use the same payment method for this refund that you used for the original transaction, unless we have expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.
Note Regarding the Start of Service Provision
We generally do not begin planting until a sufficient number of orders has been received for the respective project region (see § 5). We do not seek separate consent to begin providing services early within the cancellation period. Your right of withdrawal therefore remains in effect for the full 14 days, regardless of the status of the planting; should planting, in exceptional cases, have already taken place within the withdrawal period, this does not affect your right to a full refund.

§8 Voluntary Extended Right of Withdrawal
Notwithstanding § 7, we grant you the following: To cancel your tree planting, simply send an informal email to info [at] clickatree [dot] com. You do not need to provide any reasons—but of course, we would be very happy to know why you have decided against helping to protect our planet. Alternatively, you can also send your cancellation by mail to the address listed above.
§9 Warranty
The statutory warranty provisions apply.
Part C: Collaboration with Business Partners
This section also applies to business owners who enter into an ongoing partnership with Click A Tree in which tree plantings or other impact projects are tied to the partner’s business volume (e.g., “one tree per missed room cleaning,” “one tree per order,” “one tree per participant”), regardless of whether the partnership is established through the online store, a custom quote, or an onboarding meeting.
§10 Subject Matter of the Contract and Billing Model
(1) Click A Tree provides tree-planting services or other agreed-upon impact services for the partner. The collaboration may begin informally, e.g., during a face-to-face meeting, at a trade show, or during an onboarding call; a written offer or formal order confirmation is not a mandatory requirement for this.
(2) Depending on the agreement, the following may be considered for billing:
a) Volume-based billing: The partner determines the monthly volume (e.g., number of trees) at its own discretion, unless otherwise agreed, with no minimum or maximum quantity. Depending on the partner, the volume is reported in one of the following ways:
- through self-service in the online store or customer portal, where the partner enters the desired quantity on their own,
- through an informal communication (e.g., by email or phone), which we then enter manually, or
- via a separately agreed-upon technical interface that automatically records the volume (e.g., the number of missed room cleanings).
b) Flat-rate agreement: a fixed, individually agreed-upon monthly amount, regardless of the actual volume.
(3) The Partner is responsible for the accuracy of the volume data it enters or reports. Click A Tree is entitled to question obviously implausible figures and, if necessary, to correct the billing in the following month. Click A Tree assumes no responsibility whatsoever for the accuracy of the figures submitted.
§11 Billing and Payment Terms
(1) Click A Tree will invoice the partner periodically (usually monthly) for the agreed-upon service.
(2) Unless otherwise agreed upon a case-by-case basis, invoice amounts are due for payment without deduction within 14 days of the invoice date.
(3) In the event of late payment, Click A Tree is entitled to charge interest on late payments at the statutory rate (§ 288 BGB), to demand reimbursement of collection costs, and to suspend further performance until outstanding amounts are paid in full.
§12 Term of the Contract and Termination
(1) In the case of volume-based billing without a minimum purchase requirement (Section 10(2)(a)), the partner is free to order no volume or any volume in individual months; no notice of termination is required for this. In this case, the partnership does not end automatically but continues as a framework until one party terminates it in accordance with paragraph 2 or 3.
(2) If a flat fee (Section 10(2)(b)) or another minimum purchase quantity has been agreed upon, the following applies: The collaboration shall continue for an indefinite period unless a fixed term has been agreed upon individually. In this case, either party may terminate the agreement in writing (e.g., by email) with 30 days’ notice effective at the end of the month.
(3) The right to terminate the agreement for cause remains unaffected. For Click A Tree, cause exists in particular if the partner remains in default of payment for overdue invoices despite a reminder and the setting of a deadline.
§13 Scope of Services and Reporting
(1) Click A Tree documents the tree-planting efforts and impact projects carried out as part of the collaboration. Depending on the agreement, the partner receives a combination of the following:
- Information about tree species, the project region, as well as photos/videos and updates from the project—typically once a year, or more frequently upon request or by arrangement—
- a certificate stating the total number of trees planted on behalf of the partner, issued once a year upon request, or more frequently by arrangement,
- Access to the customer dashboard displaying the impact metrics derived from order data.
(2) We do not provide individual GPS coordinates for each tree. Georeferencing at the individual-tree level would entail a disproportionate amount of additional on-site data collection effort and is not part of our projects. However, we are happy to provide the GPS coordinates for the project as a whole.
(3) The exact scope of reporting services in each individual case is determined by the specific agreement with the partner.
§14 Listing as a Reference
Click A Tree is authorized to name the Partner (name and logo) on its website, in presentations, and in press releases as a collaboration partner, provided that and as long as the Partner does not object. The parties shall consult separately in advance regarding the publication of detailed case studies containing specific key metrics (e.g., press articles, case studies with partner names and figures). The partner may object in writing to being named as a reference at any time, with future effect.
Part D: General Final Provisions
§15 Liability
(1) We are fully liable for damages resulting from injury to life, body, or health that are caused by an intentional or negligent breach of duty, as well as for other damages resulting from an intentional or grossly negligent breach of duty on our part or from the intent or gross negligence of a legal representative or agent acting on our behalf. Furthermore, liability under the Product Liability Act and liability arising from the assumption of a warranty remain unaffected.
(2) For damages not covered by paragraph 1, we shall be liable only in the event of a breach of a material contractual obligation (cardinal obligation), the fulfillment of which is essential for the proper performance of the contract and on the observance of which the contracting party may reasonably rely. In this case, liability is limited to the damages typical for this type of contract and foreseeable at the time the contract was concluded.
(3) With respect to business entities (Part C), liability for consequential damages, lost profits, and pure financial losses is excluded to the extent permitted by law.
(4) Any further liability is excluded.
§16 Language of the Contract
Both German and English are available as contract languages.

§18 Final Provisions
(1) Should any provision of these Terms and Conditions be or become invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the applicable statutory provision.
(2) The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this shall apply only to the extent that it does not limit the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.
(3) If the partner is a merchant, a legal entity under public law, or a special fund under public law, Radolfzell shall be the exclusive venue for all disputes arising from contracts under Part C.
