Yes, within clear limits. Different rules apply to customers and employees.

Gifts to customers and business partners

• Deductible as a business expense up to €50 per recipient and fiscal year (§ 4 Abs. 5 Satz 1 Nr. 1 EStG).
• For companies entitled to input tax deduction, the net amount counts.
• The €50 is a tax-free limit. Even 1 cent over, and the entire amount is no longer deductible.
• Gifts are recorded individually and separately from other business expenses.

Gifts to employees

• Non-cash benefits up to €50 gross per month are exempt from wage tax and social security contributions (§ 8 Abs. 2 Satz 11 EStG). Other non-cash benefits in the same month count towards this limit.
• The €60 limit for courtesies applies to personal occasions such as birthdays or weddings. Christmas is not included.
• If the gift is presented at the Christmas party, it may fall under the tax-free allowance of €110 per person and event.

With €5 net per tree, you comfortably stay below these limits. Five trees per person cost €25 net.
